I have been Furloughed by my Employer – Can they make me Redundant?

Can I be made redundant whilst I am on furlough?

Under the terms of the Government’s Coronavirus Job Retention Scheme (CJRS), whilst the underlying purpose of the Scheme is to allow an employer to retain their staff, the terms imply that they can make your role redundant while on furlough or afterwards.

Does being on furlough affect my employment rights?

The fact that you are on furlough does not affect your employment rights and where you have 2 years or more service, a fair process should be followed to avoid your redundancy from being unfair.

If your role has been put at risk of redundancy or you have been made redundant whilst on furlough and you believe this to be unfair, please contact our employment team lawyers Jo Cullen or Chloe Baxter for advice on your prospects to achieve a settlement or to pursue an employment tribunal claim.

If your employer has given you a settlement agreement to record the terms of your leaving with an enhanced compensation payment, we can provide you with independent legal advice.

our lawyers deliver an excellent quality service, independently recognised by The Law Society and our many returning clients.
